部屋は空いている。
制度が、重い。
空いている部屋を何かに使えないか。そう考えて調べると、まず民泊に行き着きます。そして制度を調べるほど、始める前に立ち止まる人が多い。この記事では、何がどう重いのかを先に具体的に並べます。民泊を否定するためではありません。あなたのやりたいことが「事業」なのか「交流」なのかで、必要な装備がまったく違うことを確かめるためです。Could that spare room be put to use? 民泊の入り口は、実は3つある
ひとくちに民泊と言っても、制度の入り口は主に3つあります。住宅宿泊事業(いわゆる民泊新法)は届出制で、年間の営業日数に最大180日という上限があります。旅館業法の簡易宿所は許可制で、日数の上限はありませんが、営業できる場所(用途地域)に制約があります。特区民泊は国家戦略特区のうち条例を定めた自治体の対象区域に限られ、条例で定める最低滞在日数の条件があります。どれを選ぶかで、必要な手続きも設備も変わります。制度の正確な内容は、観光庁の「民泊制度ポータルサイト」で確認してください。Minpaku is one word with three main legal entrances. The Private Lodging Business Act (the "minpaku law") uses a notification system, capped at 180 operating days per year. A simple-lodging permit under the Hotel Business Act has no day cap, but restricts where you can operate by zoning. Special-zone minpaku exists only in areas of national strategic zones whose municipalities have enacted ordinances, with minimum-stay conditions set by those ordinances. ハードル① 届出は「書類一枚」で終わらない
いちばん軽い住宅宿泊事業の届出でも、届出書を出して終わり、ではありません。物件と地域によって、消防法令への適合(自動火災報知設備や誘導灯などの設備が必要になる場合があります)、物件の権利関係(賃貸なら大家さんの承諾が要ります。分譲マンションなら管理規約の確認が必要で、民泊を禁止している規約は珍しくありません)、自治体の条例(法律の180日上限に加えて、営業できる区域や期間をさらに絞っている自治体があります)、そして宿泊者名簿の備え付けや標識の掲示といった運用上の義務がついてきます。Even the lightest route — notification under the minpaku law — does not end with submitting a form. Depending on the property and the area, it comes with fire-code compliance (automatic fire alarms and exit lighting may be required), property rights (a landlord's consent if renting; for a condominium, the building rules must be checked, and rules banning minpaku are not rare), municipal ordinances (some municipalities restrict operating areas and periods beyond the 180-day cap), and operating duties such as guest registers and posted signage.

ハードル② 営業できるのは年180日。手間は、毎回
住宅宿泊事業には年間180日の上限があります。一年のうち人を泊められる日数の上限が、構造として先に決まっているということです。その一方で、清掃、鍵の受け渡し、ゲスト対応、予約管理、レビューへの対応は、宿泊のたびに発生します。自分が住んでいない家で運営する家主不在型の場合は、原則として住宅宿泊管理業者への委託が必要になり(一定の例外はあります)、委託費もかかります。条件によっては、初期費用だけで数百万円規模になることもあります。私たちの代表も、渋谷区で一度検討して、同じ壁にぶつかりました。The minpaku law caps operation at 180 days a year — meaning the ceiling on the number of nights you can host is fixed by structure before you begin. Meanwhile cleaning, key handoffs, guest support, booking management, and review responses recur with every single stay. If you do not live in the property, you must in principle contract a registered lodging-management company (with limited exceptions), which adds its own fees. Depending on conditions, up-front costs alone can reach several million yen. Our founder once looked into it in Shibuya and hit the same wall.
それでも、民泊が向いている人
ここまでのハードルは、民泊が「宿泊事業」の制度である以上、当然のものでもあります。空き部屋を事業として運用したい人にとって、民泊は国が整備した正式な制度であり、越えたハードルはそのまま参入障壁という武器になります。向いているのは、収益を目的として据えられる人、清掃や鍵の受け渡しを仕組み化できる人、そして物件の条件(管理規約・用途地域)をクリアできる人です。当てはまるなら、調べる価値は十分にあります。These hurdles are natural, given that minpaku is a framework for a lodging business. For anyone who wants to run a spare room as a business, it is a proper, nationally established system — and every hurdle you clear becomes a barrier to entry working in your favor. It suits people who can make revenue the goal, systematize cleaning and key handoffs, and clear the property conditions of building rules and zoning. If that is you, it is well worth investigating.
目的が「交流」なら、装備は軽くていい
ここで一度、思い出してほしいことがあります。そもそも、何がしたかったのか。部屋を貸す事業を始めたかったのか。それとも、空いている部屋に誰かの気配が戻ったらいいと思っただけなのか。後者なら、必要な装備はずっと軽くなります。宿泊料を受け取らずに、上京して就職活動をする若者を最大2泊3日迎える、という開き方があります。Here, pause and remember what you wanted in the first place. Did you want to start a room-rental business? Or did you simply think it would be good if a spare room had someone's presence in it again? If it is the latter, the equipment you need becomes far lighter. There is a way to open the room without charging for lodging: welcoming a young job seeker for up to two nights and three days.
